Special Power of Attorney - How They Work

Special powers of attorney for financial management carry the same caveat as general powers of attorney: placed into the wrong hands, they can become a license to steal. Like all financial powers of attorney, you must be certain that the person you appoint to act as your agent is absolutely trustworthy. Here are some examples of special powers of attorney and how they work.

A special power limits your agent's authority and is generally used only in specific circumstances. For example, you may be in the process of purchasing a home but, nearly a year ago, you purchased a non-refundable European vacation and you won't be available to sign all of the real estate documents. A special power of attorney can authorize your agent to act on your behalf and sign all necessary papers to complete the purchase.

Under this scenario, your agent's authority is very limited.

Contrast this to a general power of attorney for financial matters. With this document, you are granting authority for someone else to handle all of your financial matters - opening and closing bank accounts, withdrawing money, purchasing or selling real property - essentially, your agent would have the ability to transact every type of financial business that you would. A very dangerous document if placed into the wrong hands.

Usually, a general power over finances should only be granted if it utilizes a "springing power". This means that your agent has no authority to act unless two qualified medical doctors provide written declarations, under penalty of perjury, that you are incapacitated and unable to make sound financial decisions. Then, and only then, does the power "spring into being", as it were, and allow your agent to act on your behalf.

A special power of attorney generally becomes effective immediately. It is granted to allow your agent the authority to handle one or more specific transactions and, again, is usually done out of convenience because you are unavailable to timely act.

Using a boilerplate form where you just fill-in the blanks to specify the exact authority you wish to grant can be a mistake. Sometimes the authority is too limited and could prevent your agent from being able to complete the particular financial transaction. For example, granting authority to "sign all documents required by my real estate broker" may not be acceptable to the lender or the escrow company. They may have different requirements and do not feel comfortable in recognizing your agent's authority under the special powers you have stated.

An attorney can assist with the creation of a special power of attorney for financial matters and, in doing so, should contact all of the companies and agencies involved to ensure that their requirements are met. The exact language used in the document can then be tailored to meet all of these needs.

Special powers of attorney can be very useful in completing certain transactions but should be tailored to meet very narrow and specific situations. If properly drafted, they are a valuable financial tool.

7. See that pipe wrench jaws are sharp and chains in good condition so they will not slip.
8. Never use any tool in such a way that you will be injured by it if it slips. Pre-analyze your movements and position your body accordingly.
9. The construction industry calls for the use of many types of hand tools. Handle them with care; treat them carefully and use them exactly for the purpose for which they were made.

Extension = Power and Control

Power and control define a good swing. Unfortunately, you don't often see these things together in a single swing. Judging by the weekend players who take golf lessons from me, you find one and not the other. Usually, weekend payers who belt the ball a mile don't know where it's going. While weekend players who hit precise drives, don't exactly crush the ball.

So how do you combine power and control in a single swing in a way that will cuts scores and shave strokes off you golf handicap? Extension.

If you've played golf long enough, you've heard the old saying "Extension means power." Well, it's true. To generate power, you must get your arms fully extended. But there' only one-way to achieve the kind of extension you need to produce great power and control. You must keep your arms from crossing past your chest as you swing. If let them cross your chest too soon, you'll short-circuit power and minimize control.

The Chicken Wing

During my years of giving golf lessons I haven't gone a single day without seeing at least one player folding his or her left wrist and arm at impact. This fatal flaw is known as the "chicken wing." Collapsing your left arm and wrist at impact does two things, both of which are bad: It not only prevents you from making consistently solid contact, it also causes inhibits control. So what creates the chicken wing?

The root cause for most players is a weak grip. With a weak grip the V formed between a player's right forefinger and thumb points up the golfer's left arm, if he's right handed. At the same time, the left arm is turned toward the target, so that the player can't see the knuckles on his or her left hand.

A weak grip causes the clubface to open during the backswing and remain open in the downswing. So instead of the clubface being perpendicular to the ground as you move to the top of your swing, it points skyward. This is known as the "open" position. I see this fault in golf instruction sessions given to players just starting out and to those who've been playing for a while. So no one is immune from it.

Power Drain

The chicken wing drains power. If a player swings down from the open position, he must square the clubface at impact to hit the ball straight and with power. The most common way for a golfer to do this is simple. She stops turning her chest. Instead, she passes her hands past her belt buckle and folds her left arm and wrist. In short, her arms outrace her chest. This flaw short-circuits power and hinders accuracy.

The most obvious way of eliminating this fault is correcting your grip. With the proper grip, the V formed by the right forefinger and thumb points up the right shoulder, not the left, an fundamental I've discussed in my golf tips. You should be able to see the brand name on the back of his or her golf glove and at least two knuckles on the left hand. You can easily monitor both positions when you look down to your grip in the address position.

Using the correct grip keeps the clubface square during the backswing. As a result, the club's toe-not the face-points skyward. A good way to practice finding this position is by looking at the club as you take it back. Finding the correct position puts you into a good situation at the top of the backswing to execute a good downswing.

Using a stronger grip helps you achieve better club position on the takeaway. That in turn eliminates the need to stall your body and employ the chicken wing to square the clubface through impact. All you have to do is turn your body through the ball. Your arms will extend and the club will release automatically, the key to longer, straighter drives.

The Body Drill

A good way to ingrain the chest turn and arm extension is to practice the body drill. Take the club back to a position where your wrists are cocked and your left arm is extended, parallel to the ground. Now just turn your body all the way through the ball and try to stop half way through your follow through, with your arms fully extended and the club's butt pointing at your belly button. Centrifugal force automatically makes the club release properly.

If you want to shave strokes off your golf handicap, you must develop a swing that exhibits power and control. You can only achieve that by fully extending your arms through impact, a position hampered by a weak grip. Check your grip the next time you're at the practice range. If it's weak, correct it. And work on the body drill described above. With practice, you'll hit the ball longer, straighter, and with more control.

Since the ancient Egyptians began using a hand-powered lathe centuries ago, man has striven to make arduous building and assembling tasks easier, quicker, and more efficient through power tools. We've come a long way from those sand-covered turning machines, but the end goal is no different from our desert-dwelling ancestors. Today, nearly every home in every industrialized country houses and uses power tools.

Even though the concept of the power tool has been around for a long time, it wasn't until the late 1800's when the first modern-era power tools became possible. The advent of electric motors made highly-efficient stationary and portable power tool technology a reality, and high-speed assembly lines made power tools both affordable and profitable.

The Bosch company was at the forefront of power tool technology in those early years. Founded in 1886 Germany by Robert Bosch, the company initially focused on automobile components with integrated electric parts, and was responsible for such developments as the first low-voltage magneto ignition. Before long, companies in other industrialized nations began developing the first electric power tools, and Bosch introduced its first power drill in 1932. Today, Bosch still engineers and manufactures automotive parts, and its power tool division has grown to include nearly every household and assembly tool on the market - including power drills, belt sanders, circular saws, and more. The early 20th century proved to be a hotbed of power tool advancements, and many companies worked hard to develop profit-turning innovations that moved their products off store shelves and into people's homes. While the term power tool traditionally conjures thoughts of electric drills and sanders, machines like the pipe threader and utility pump are also considered power tools. This is the area the Ridgid company focused on when it was founded in Elyria, Ohio, in 1923. Like their power tool manufacturing competition, Milwaukee currently produces portable and stationary power tools like circular saws, drills, band saws, grinders and sanders - over 500 different models in all. Unlike their competition, many of Milwaukee's power tools are released in both 120 and 230 volt models, drawing the line between household and commercial/industrial power.

Best known for the Skilsaw they invented in 1924, the Skil power tool company evolved out of the Michel Electric Handsaw Company when they entered the power tool market. Fueled by the ingenious circular saw invention, the company elevated itself to the upper echelon of the small power tool industry with jig saws, grinders, sanders, and a whole slew of handheld, cordless power tools. In 1996, the Bosch company purchased Skil but still keeps its power tools on shelves worldwide as one of the most popular power tool lines on Earth.

The Delta company has changed hands several times since it was founded by Herbert Tautz in 1919 in his Milwaukee, Wisconsin garage. Tautz focused on small tools but when Delta was purchased by Rockwell in 1945, the company made a profitable shift to the stationary tools - like planers and bench sanders - it's renowned for today. Delta isn't the only name this line has carried, however; Rockwell enveloped the company on takeover before selling it to Pentair, which re-introduced the Delta name before selling out to Black & Decker in 2004.

A veritable power tool power house, the Craftsman brand was coined by the Sears company in 1927. At first, the company primarily manufactured common hand tools like hammers and screwdrivers; but soon jumped on the power tool bandwagon and is now one of the top-selling producers of all power tools, both stationary and portable.

S. Duncan Black and Alonzo G. Decker founded the Black & Decker small machine shop in 1910 in Baltimore, Maryland; and the duo found their niche in the power tool industry by inventing the electric drill seven years later. The pistol-grip and trigger style drill became popular and is now a staple on construction sites and in households alike. Realizing the profit potential of power tools, Black & Decker has grown and acquired several other popular power tool brands, including DeWalt, Porter Cable, Delta, and Kwikset.

As industrialized nations become increasingly technology-driven, power tool production stands to increase as lightweight, powerful, and longer-lasting batteries try to match the power and reliability of corded power.
